1. The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 234/2024, registered at Police Station Sahashpur Lohara, District-Kabirdham (CG) for
2 the offence punishable under Section 103(1), 61(2) A, 238-B of BNSS, 2023. 2. The prosecution story in brief, is that the complainant Manoj Sahu has lodged a report on 10.08.2024 that his Sister was married to Lukesh Sahu at Village-Chimagondi. She has 3 childrens- 2 girls and 1 boy. Lukesh used to suspect Gyalin Bai, thereafter he left her so she was residing at Kalyanpur with her parents and childrens since 3 years. Thereafter she started living in a rented house of Rajaram. Gwalin Bai has applied in the Kawardha Court for maintenance from her husband Lukesh and the Court ordered her to get a monthly maintenance of Rs. 4500/- for her childrens. On 18.07.2024 Gwalin Bai went to Kawardha on her scooty bearing no. CG 09 JQ 9044 to get the amount of maintenance but she did not returned home. Then her father lodged a missing report on 22.07.2024. Upon investigation the police found the dead body of deceased Gwalin Bai and found that accused persons Lukesh Sahu and Rajaram Sahu committed murder of deceased Gwalin Bai. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. He further contended that none of the witness has supported the prosecution story. The applicant is in jail since 11.08.2024. The applicant is a local resident. The conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 3
4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5.
I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Rajram Sahu involved in Crime No. 234/2024 under Section 103(1), 61(2) A, 238-B of BNSS, 2023 at Police Station- Sahaspur Lohara, District- Kabirdham, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously preferably within 8 months in accordance with law, if there is no legal impediment. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
