Neutral Citation No. - 2025:AHC:49573 Court No. - 68 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 6459 of 2025 Applicant :- Subedar Singh Opposite Party :- State of U.P. Counsel for Applicant :- Hari Bans Singh,Veer Bhadra Singh Counsel for Opposite Party :- Akhilesh Kumar Tiwari,G.A.,Sheshadri Trivedi Hon'ble Ashutosh Srivastava,J. This is a second bail application. First bail application, of the applicant, being Criminal Misc. Bail Application No. 22885 of 2024, was rejected by coordinate Bench of this Court vide order dated 10.09.2024. Heard learned counsel for the applicant, Shri Sheshadri Tiwari, learned counsel for the first informant and Shri Rajesh Kumar Singh, learned A.G.A. for the state and perused the records. Present second bail application has been filed on behalf of the applicant, with a prayer to release the applicant on bail in Case Crime No. 18 of 2024, under Sections 147, 148, 323, 504, 506, 307 and 325 I.P.C., Police Station Khutahan, District Jaunpur, on the additional grounds that the co-accused namely Vishal Singh and Satya Prakash Singh, have been granted bail, there is contradiction in the statement of witnesses; charge sheet has been filed, cognizance has been taken but till date no charge has been framed in the present case and there is no possibility of early conclusion of trial; and applicant is languishing in jail since more than 15 months. Learned counsel for the first informant submits that the present bail application has been filed almost on identical grounds. The case of the applicant is at no parity with the co-accused, applicant is a hardened criminal having criminal history of 21 cases and in one case being S.T. No. 86 of 2013 arising out of Case Crime No. 728 of 2012 under Section 302/149, 307/149 and 120-B I.P.C., Police Station Sardhana, District Jaunpur, mentioned in the bail rejection order dated 10.09.2024 the applicant has been convicted and sentenced to undergo life imprisonment along with fine. Considering the aforesaid submissions made by the learned counsel for the first informant as well as considering the long criminal history of the applicant this Court finds no good ground to interfere in the present second bail application. Accordingly, the present bail application is rejected. Order Date :- 17.3.2025 pks Digitally signed by :- PAWAN KUMAR SINGH High Court of Judicature at Allahabad
