Petition under Section 482 Qf BNSS, 2023 is filed praying that in the \'' -a:. circumstances stated in memorandum of grounds of criminal Petition, the High Court may be pleased to :nlarge the petitioners/A2 to A7 on bal-I in the event of their arrest in conne6ti6h with F.I.R.No.14/2024 Dt:27-01-2024 .] I .i``;,:;i .:.,iJ . : I.i;., r'.^ on the file of Singanamala P.S:, for the alleged offences punishable under Section 326, 506 I/w 34.IPC; The petition coming on for'`hearing, upon perusing the petition and memorandum of grounds of cr'iminal petition and upon hearing the arguments of Sri P.Sravan Kumar Reddy, Advocate for the Petitioners and public Prosecutor for the Respond';nt, the Court made the following; ORDER:- The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/A2 to A7 to grant anticipatory bail in connection with Crime No.14 of 2024 of Singanamala Police Station, Ananthapuram District, registered for the offences punishable under Sections 326, 506 r/w 34 of IPC. 2. Case of the prosecution, in brief, is that on 26.01.2024 at about 6.00 p.m., at Peddajalapuram Village of Singanamala Mandal, the accused picked up quarrel with the defacto complainant Subbarayudu and his family members, then beat them with stones and caused injuries to the defacto complainant and his wife Eswaramma Dand his son Lakshmaiah. The accused threatened the defacto complainant and his family members, that they would see their end. On the hues and cries, the surrounding people came and rescued them from the accused. Basing on the report of theJdefacto complainant, the case was registered and investigated into. 3. Heard the learned counsel forthe petitioners and learned Assistant Public Prosecutor. Perused the record. 4. Upon perusal of the material on record, it appears that there was a quarrel between the defacto complainant's party and the accused party. This is a case and counter-case situation. The petitioners also lodged a report against the defacto complainant and others which is subject matter of case in Crime No.15 of 2025 at Singanamala Police Station, Ananthapuram District, for the same offences under Sections 326 and 506 read with Section 34 of the IPC. Petitioners Nos. 2 to 4 are women, and Petitioners Nos. 5 and 6 are aged about 66 and 67 years, respectively. The present case has been registered as the de facto complainant sustained grievous injuries. However, the complaint does not specify which of the accused caused those injuries. Moreover, the FIR filed by the de facto complainant does not clearly establish the genesis of the incident. Given that, this is a case and counter-case, and most of the witnesses have already been examined. `>`` 5. In view of the aforesaid facts and circumstances of the case, this Court is inclined to consider request of petitioners for grant of anticipatory bail. 6. Accordingly, in the event of their arrest, petitioners herein/A2 to A7 shall be released on bail on each of them executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of the arresting police officials, and. also on condition that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioner No.1 shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday, between 10.00 am and 01.00 pmi till filing of the charge sheet. It is made clear that the petitioners shall scrupulously comply with the above conditions and breach of any of the above conditions will be viewed seriously and prosecution is at liberty to move an application for cancellation of the bail. 7.
