HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22458 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J. HON'BLE SANJIV KUMAR, J. Heard Mr. Prasant Kumar Pandey, learned counsel for the petitioner in support of this petition at substantial length and Mr. K.K. Nishad, learned State Law Officer on behalf of State. This petition has been filed for issuing a writ, order or direction in the nature of certiorari quashing the impugned first information report dated 13.09.2025 registered in Case Crime No. 0338 of 2025, under Section 74, 352, 351(3) of Bhartiya Nyay Sanhita, 2023 and Section 7/8 Protection of Children from Sexual Offences Act, 2012, Police Station-Rasara, District- Ballia and also not to arrest in the aforesaid case. A perusal of the impugned F.I.R. shows that though the occurrence has happened in two parts; one of which was a regular feature of passing comments on the prosecutrix, the informant's grand-daughter. In the other incident dated 13.9.2025 the petitioner was not there. The conduct of the accused who have been reported to the police is one that militates against norms of a civilized society and outrages the dignity of women. All the petitioners, prima facie, as the F.I.R. shows, and nothing more show a conduct of eve teasing a young girl and misbehaving with elders of the family too, which does not entitle the petitioner to any kind of relief in the exercise of our discretionary writ jurisdiction under Article 226 of the Versus Counsel for Petitioner(s) : Prashant Kumar Pandey Counsel for Respondent(s) : G.A. Priyanshu Singh .....Petitioner(s) State Of Up And 4 Others .....Respondent(s) Constitution of India. The writ petition is summarily dismissed.
