Plaintiffs-petitioners instituted a suit in the year 2007 which was registered as Original Suit No. 79 of 2007 and the same was decreed on the basis of compromise entered between the parties on 14.09.2007. Against the compromise decree, no appeal was preferred nor any application for recalling the compromise decree was moved by defendants-respondents. 2. An execution case no. 1 of 2013 was filed which is pending consideration. The sole prayer made is for expeditious disposal of Execution Case No. 1 of 2013. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon executing court to decide the Executing Case No. 1 of 2013, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
