Heard Sri Saurabh Kumar Pandey, learned counsel for the petitioners and Sri Dinesh Kumar Tiwari, learned Standing Counsel appearing for the State-respondents. The present petition has been filed seeking a direction to the respondent No.2, the Commissioner, Azamgarh Mandal, Azamgarh to decide the Appeal No.226/M (Parshuram Vs. Bharat and others), arising out of proceedings under Section 38(4) of U.P. Revenue Code, 2006, expeditiously and within a stipulated time period. Counsel for the petitioners has referred to the 'order sheet' of the case, a copy whereof has been appended to the writ petition to point out that although several dates have been fixed but for some reason or the other, matter has been adjourned. The delay in disposal of the case is stated to be causing hardship to the petitioners. Accordingly, a prayer is made for a direction to the respondent No. 2, the Commissioner, Azamgarh Mandal, Azamgarh to conclude the proceedings at an early date. Counsel for the State-respondents has no objection to the prayer. Having regard to the aforesaid, the present petition is disposed of with an observation that the respondent No. 2, the Commissioner, Azamgarh Mandal, Azamgarh, would make an endeavor to conclude the proceedings of the case, which is stated to be pending before it, preferably within a Versus Counsel for Petitioner(s) : Saurabh Kumar Pandey Counsel for Respondent(s) : C.S.C., Rameshwar Prasad Shukla Abhishek And Another .....Petitioner(s) State Of U.P.
