Heard learned counsel for the petitioner and Sri Rajesh Kumar Pal, learned Standing Counsel for the State-respondents. 2. The petitioner is the resident of Village Dikshitpur (Maharajganj), Tehsil- Aurai, District Sant Ravidas Nagar and presently residing at Village and Post-Bharpura, Tehsil-Sadar, District Mirzapur. According to petitioner, he is 'Gond' by caste which comes under the Scheduled Caste category. As per the Government Order dated 24.02.2023, the 'Gond' caste has been put under the category of 'Scheduled Tribes' for four districts i.e. Sant Kabir Nagar, Kushinagar, Chandauli and Sant Ravidas Nagar, and petitioner being the resident of Sant Ravidas Nagar is entitled to get caste certificate under the category of Scheduled Tribe. 3. The grievance of the petitioner is that respondent-authority is not deciding the application of the petitioner for issuance of caste certificate under the Scheduled Tribe category pursuant to the Government Order dated 24.02.2023 despite several representations made by the petitioner. 4. Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to the respondent no.4 to consider the grievance of the petitioner. 5. Considering the facts and circumstances of the case and without adverting into the merits of the case, we dispose off the writ petition permitting the petitioner to file a fresh representation alongwith certified copy of this order raising all his grievances before the respondent no.4-Tehsildar, Tehsil-Aurai, Versus Counsel for Petitioner(s) : Krishna Bihari, Om Prakash Counsel for Respondent(s) : C.S.C. Gyanendra Dhruw .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) District Sant Ravidas Nagar within a period of one month from today. In case, any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same in accordance with law within a period of two months thereafter from the date he receives the representation of the petitioner.
