Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 2. The petitioner is aggrieved by the impugned recovery/notice dated 09.05.2025 issued by the respondent no.3-District Magistrate, District Mirzapur by which the petitioner has been E-Challaned for illegal transportation of minerals. 3. The said notice has been assailed by the petitioner on the ground that the charge levelled against the petitioner in the notice is incorrect and based on no material on record. 4. Be that as it may, the petitioner has assailed the recovery/notice dated 09.05.2025 issued by the respondent no.3. The petitioner has adequate remedy of filing the objection against the notice before the authorities demonstrating that he has not done any illegal transportation. 5. In such view of the fact, the writ petition is disposed off with liberty to the petitioner to file reply/objection to the notice dated 09.05.2025 before the authority concerned i.e. respondent no.3-District Magistrate, District Mirzapur, who shall consider and decide the said reply/objection of the petitioner within a period of one month from the date of filing the reply/objection strictly in accordance with law after giving due notice and opportunity of hearing to the petitioner.
