Learned counsel for the applicant has submitted that the applicant had filed a complaint under Section 138 of the Negotiable Instruments Act, which was registered as Complaint Case No. 2472 of 2020 (Surendra Kumar Tiwari vs. Jafar Alam), Police Station Hapur Nagar, District Hapur, now renumbered as Complaint Case No. 3474 of 2020, pending before the Court of Civil Judge (Senior Division)/Fast Track Court, Hapur. 3. It is further submitted that the complainant was examined as P.W.-1 in the year 2022, but his cross-examination has not yet been completed despite several opportunities having been granted to respondent no. 2. The prolonged pendency of the case is causing financial hardship to the applicant. 4. Considering the aforesaid facts and circumstances, the learned Civil Judge (Senior Division)/Fast Track Court, Hapur, is directed to make all possible endeavours to conclude and decide the aforesaid complaint case expeditiously, strictly in accordance with law, without granting unnecessary Versus Counsel for Applicant(s) : Kamlendra Singh Jadaun Counsel for Opposite Party(s) : G.A.
