Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. Learned counsel for the applicant has submitted that he is an accused in Case No.3623 of 2015 (State vs. Faeem alias ATM & Ors.) arising out of Case Crime No.292 of 2014 under Section 406/120-B IPC at Police Station-Izzat Nagar, District- Bareilly. It was further submitted that proceedings in the case are not moving forward because the applicant/accused is continuously in jail since 15.6.2011 in another Case Crime No.167 of 2011 under Section 302 IPC, Police Station- Galsheed, District Moradabad. Learned counsel, therefore, prays that a direction be issued to the learned trial court to decide the said case as expeditiously as possible. 3. From the foregoing circumstances, it is apparent that Case No.3623 of 2015 could not be proceeded because the applicant/accused is already in jail in another criminal case. 4. Under such circumstances, the applicant through his counsel may appear in Case No.3623 of 2015 before the concerned court by disclosing the fact that he is languishing in jail in another criminal case registered at Police Station-Galsheed, Versus Counsel for Applicant(s) : Abhay Mishra Counsel for Opposite Party(s) : G.A. Faeem Alias ATM .....Applicant(s) State of U.P. .....Opposite Party(s) District Moradabad. The concerned court will take all appropriate steps to decide the case as per law. 5.
