Order 19/05/2025
1. The instant 2nd bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused- petitioner has been arrested in connection with FIR No.293/2024, registered at Police Station Baroni, District Tonk, for the offence(s) under Sections 143, 341, 323 and 336 of the IPC.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that first bail application of the accused-petitioner was dismissed vide order dated 10.02.2025 with the liberty to file afresh after recording of the statement of injured witnesses Pappu and Dhara Singh. It is further contended that statement of PW-4 Dhara Singh has been recorded and in his cross-examination he admitted the fact that he remained hospitalised for only one day. It is also contended that concerned medical jurist PW-1 in his cross-
[2025:RJ-JP:20926] (2 of 3) [CRLMB-6446/2025] examination clearly stated that injury sustained to Dara Singh was not dangerous to life the other co-accused Meghraj, Maneesh, Banshi Lal and Toofan have already been enlarged on bail. The accused-petitioner is in custody since 08.12.2024 and further trial of the case may take considerable time, therefore, the second bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the grant of second bail application and contended that PW-4 Dhara Singh in his examination in chief has clearly attributed injury at his head to present petitioner. Injury report shows that injured sustained fracture of parietal bone, therefore considering the allegation levelled against the petitioner, second bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case, considering the fact that concerned doctor opined that injury is not dangerous to life and the accused-petitioner is in custody since long and trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused- petitioner on bail.
6. Accordingly, the second bail application under Section 483 of B.N.S.S., is allowed and it is ordered that the accused-petitioner, Sonu @ Kalu S/o Banshilal, in connection with FIR No. 293/2024, registered at Police Station Baroni, District Tonk,, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before
