This is an application under Section 483 BNSS, 2023 praying for grant of bail to the accused/petitioner Sri. Binod Guwala who was arrested on 07.08.2025 in connection with Duliajan PS Case No. 116/2025 under Section 305 of the BNS, 2023 added Section 324(5) of BNS, 2023 R/W Section 3(2)(a) of PDPP Act. 3. The facts of the case is that on 21.06.2025, the informant namely Sri. Pargab Dutta has lodged an FIR before the Officer-in- Charge of Duliajan Police Station alleging, inter alia, that a tower of 66 KV Namrup-Tinsukia D/C line Loc No. 62 has been damaged by the miscreants located at Naharkatia Bamun Gaon. 4. It appears that the co-accused persons have already been granted bail by the Ld. Court below and copy of said order has been furnished. The petitioner has been in custody for 47 days. 5. Having regard to the above, the prayer for bail is allowed. The accused/petitioner Sri. Binod Guwala shall be released on bail of Rs. 20,000/- with 2(two) sureties of the like amount to the satisfaction of the Ld. C.J.M, Dibrugarh under the following conditions : (i) The petitioner shall not approach the victim or the victim’s family members at any point of time. (ii) The petitioner shall cooperate with the investigation and appear before the I/O as and when called for. (iii) The petitioner shall not tamper with the evidence or influence the witnesses connected with the case.
