HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 6094 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, Shri Karunesh Singh, learned counsel for the informant as well as learned AGA for the State. 2. The accused-applicant seeks bail in FIR/Case Crime No.852 of 2022 under Sections 302, 323, 325, 504, 506 IPC, P.S.- Kotwali Sahar, District- Hardoi. 3. In terms of the FIR, allegations were leveled as the applicant had caused fire arm injury from the licensed weapon which resulted in the death of the deceased. 4. In the light of the said, learned counsel for the applicant argues that the FSL report on record does not corroborate with the allegation that the fire arm injury was caused by the weapon as has been alleged in the FIR. He further argues that the co-accused, namely, Raman Singh has been enlarged on bail vide order dated 19.06.2025 passed by the Coordinate Bench of this Court in Criminal Misc. Bail Application No.12657 of 2024 and all the witnesses have been examined except one formal witness. 5. Learned AGA as well as learned counsel for the informant has opposed the prayer of the applicant by arguing that it is the case of double murder by the applicant. They, however, do not dispute the fact that the applicant has no criminal history and the co-accused has already been enlarged on bail. 6. Without considering the ground of parity that the other co-accused has been enlarged on bail, the fact remains that the FSL report does not Versus Counsel for Applicant(s) : Ajeet Kumar Singh, Vikas Pandey Counsel for Opposite Party(s) : G.A., Avnesh Kumar Singh, Karunesh Singh Saurabh Singh .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
corroborate with the allegations of fire arm injury being caused by the weapon assigned to the applicant. Apart from the same, all the fact witnesses have been examined and there is nothing on record to suggest that the applicant, being enlarged on bail, can have any adverse effect on trial coupled with the fact he is in custody since 28.10.2022 and has no previous criminal antecedent, I am of the view that the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed. 7.
Let the applicant- Saurabh Singh be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
