Biswas, learned counsel appearing for the accused petitioners as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Pranab Gogoi @ Karna and Rahul Gogoi @ Bhismo @ Hiteswar, who are stated to have been arrested on 15.01.2025 praying for grant of bail in connection with Sessions Case No. 20(S-S)/2025 under Sections 118(2)/103(1)/3(5) BNS arising out of Demow PS Case No. 4/2025 under Sections 118(2)/3(5) BNS added Section 103(1)/238 of BNS Act. 3. Learned counsel for the petitioner submits that in the meantime, investigation has been completed, resulting in a charge-sheet dated 28.02.2025 and Sessions case No. 20/2025 has been registered and presently at the stage of trial, wherein five out of total twelve listed witnesses have already been examined. 4. Learned counsel for the petitioner has drawn my attention to the order dated 08.09.2025 granting interim bail and prays for making the same absolute. Further, contending and undertaking on behalf of the accused persons that they shall co- operate with the remaining trial. 5. Heard Mr. D. P. Goswami, learned Additional Public Prosecutor. 6. Scanned TCR is received and I have perused the relevant portion wherein it reveals that five witnesses out of twelve witnesses have been examined. 7. Thus, I find that trial is almost half way through and I do not deem it necessary to cancel the interim bail granted to the accused persons. Page No.# 3/3 8. Accordingly, the interim bail granted to the petitioners vide order dated 08.09.2025 is hereby made absolute subject to the same conditions: (i) That they shall be available for the remaining trial; (ii) They shall not in any matter hamper or tamper with the evidence. 9. Accordingly, this bail application stands allowed and disposed of. JUDGE Comparing Assistant
