This application has been preferred by the appellant for condoning a delay of 55 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and a delay of 55 days in filling the appeal is hereby condoned. I.A. This appeal is directed against the order dated 08.04.2025 passed by the learned Additional Sessions Judge- IX, Giridih in B.P. No. 166/2025 in connection with Jamua P.S. Case No. 38/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the appellant as well as the other named accused persons were trafficking the women of rural areas who were working in Banvasi Vikas Ashram Sanstha Giridih to Rajasthan for the purposes of prostitution. Submission has been advanced by the learned counsel for the appellant that the exactly in similar circumstances, co-accused Binod Kr. Yadav has been granted

bail in Cr. Appeal (DB) No. 551 of 2025. It has been submitted that the appellant is in custody since 27.02.2025. Learned A.P.P. though has opposed the prayer for bail of the appellant, but has not disputed the aforesaid facts.
Regard being had to the fact that one of the similarly situated co-accused having been granted bail by this Court, we, while setting aside the order dated 08.04.2025 passed by the learned Additional Sessions Judge-IX, Giridih in B.P. No. 166/2025 in connection with Jamua P.S. Case No. 38/2025, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, Giridih in connection with Jamua P.S. Case No. 38/2025. This appeal is allowed. (Rongon Mukhopadhyay, J.)
