None appeared on behalf of the petitioner to press this petition nor any request for adjournment or pass over has been made whereas learned A.G.A. for the State is present. 3. This Court on 29.7.2024 had passed the following order :- 1. Heard learned counsel for petitioner, learned A.G.A. for the State and Sri Mukhtar Ahmed, learned counsel for opposite party no.4. 2. This petition seeks issuance of a writ for quashing the F.I.R. dated 02.06.2024 bearing Case Crime No.0171 of 2024, under Sections 366, 323, 376 & 506 I.P.C., Police Station Ajgain, District Unnao. 3. Learned counsel for the petitioner has drawn the attention of this Court towards Annexure-SA-1 to the supplementary affidavit, which is an original compromise deed entered into between the petitioner and opposite party no.4. 4. Learned counsel for both the parties state that parties have entered into a compromise and they are not willing to contest the case against each other. 5. So as to verify the contents and parties of the compromise deed, let the original deed of compromise be sent to the Senior Registrar of this Court. On 2.8.2024 parties shall appear before the Senior Registrar for the purpose of verification of compromise deed as well as parties. 6. The Senior Registrar of this Court after due verification shall submit his report Versus Counsel for Petitioner(s) : Mohd. Salman, Ana Fatma, Arshad Jameel Counsel for Respondent(s) : G.A., Mukhtar Ahamad Dileep Alias Dileep Kumar .....Petitioner(s) State Of U.P. Thru. Secy. Home Deptt. Govt. Of U.P. Lko. And Others .....Respondent(s) before this Court. 7. List this case on 7.8.2024 along with the report of the Senior Registrar. 8. Interim order, if any, shall continue till the next date of listing. 4. In pursuance of the aforesaid order dated 29.7.2024, the Senior Registrar has submitted the report dated 2.8.2024 to the effect that the compromise between the petitioner and respondent no. 4 has been verified, however none is present on behalf of the petitioners. 5. Learned A.G.A. on the basis of instructions received from Sri Anil Kumar Rawat, Sub-inspector, police station Ajgain, district Unnao submits that after investigation charge-sheet no. A151/2024 dated 27.6.2024 has been filed in the court of learned C.J.M., Unnao on 10.10.2024. The instructions are taken on record. 6. In view of the above, the remedy available to the petitioner lies elsewhere. 7. The petition is dismissed for want of prosecution. 8. Interim order, if any, stands vacated.
