1. The present writ petition has been filed for issuance of direction upon the respondent-Jharkhand State Housing Board to take decision on the petitioner’s representations dated 25th August, 2011 and 27th February, 2013. Further prayer has been made for issuance of direction upon the said respondent to transfer ownership of MIG Plot no.M/58, Housing Colony, Dhanbad in favour of the petitioner by executing registered title deed of settlement in his favour subject to payment of deferred interest.

Learned counsel appearing on behalf of the respondents, while referring to the counter affidavit dated 20th February, 2022, submits that the allotment of the aforesaid plot made to the petitioner was already cancelled vide memo no.761 dated 25th November, 2011, a copy of which has been annexed as
Annexure-B to the said counter affidavit. It is, thus, submitted that the prayer made in the writ petition is itself misconceived.

Learned counsel for the petitioner submits that the petitioner has filed an interlocutory application being I.A. No.3074 of 2020 for amendment in the writ petition, seeking challenge to the aforesaid order dated 25th November, 2011.

Having heard learned counsel for the parties and considering that on the date of filing of the writ petition, there was no allotment in favour of the petitioner, as the same was already cancelled vide memo no.761 dated 25th November, 2011, this Court does not intend to entertain the present writ petition and the same is, accordingly, dismissed.
5. The petitioner is, however, at liberty to take appropriate recourse against the aforesaid order as contained in memo no.761 dated 25th November, 2011 as permissible under law.
6. I.A. No.3074 of 2020 is also dismissed.
