Hon'ble Shri Bibhu Datta Guru , Judge Order on Board 28.04.2025 1. By the present writ petition, the petitioner who is working as Registrar in the C.M. Dubey Post Graduate College, Bilaspur District Bilaspur is seeking a direction towards the respondents/State for grant of first, second and third time scale increment to the petitioner along with all consequential benefit as the petitioner is entitled for the same looking to the length of service. 2. Learned counsel for the petitioner submits that the petitioner was appointed as Lower Division Clerk in the respondent No. 3 College on 03.10.1988 and promoted subsequently to the post of Registrar on 01.01.2001 and he has rendered his service with the respondent college since more than 37 years, the petitioner is entitled for benefit 3 of increment as has been provided under various circular of the State Government after completion of 8 years, 16 years and 30 years service. The said circulars are also applicable to the employees of the Government aided college/institutions. The petitioner submitted his representation to the Deputy Director on 15.01.2025 and the petitioner is going to be retired in the month of July, 2025. 3. Learned counsel for the State submits that if the representation of the petitioner claiming the increment first, second and third as per various circular of State Government, if the representation is still pending, the same shall be considered in accordance with the circular applicable to the present petitioner and the college where the petitioner is working. The representation of the petitioner will be considered and decided within a stipulated period. 4. I have heard both the counsels for the parties and perused the pleadings of the petitioner. 5. It appears from the pleadings that the petitioner is an employee of the respondent no. 3 and is discharging his duty since 1988 and he has completed more than 37 years of his service, however the petitioner has not been granted the increment as prescribed by the circular of the State Government and the petitioner is going to be retired in the month of July, 2025. The petitioner has submitted a representation to the Deputy Director Higher Education, State of Chhattisgarh which is pending since 15.01.2025, hence the writ petition is disposed with a direction to the Deputy Director to decide the same within a period of 50 days in accordance with law as well 4 as the circular applicable to the case of the petitioner as well as the college in which the petitioner is working. 6.
