Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking mainly for the following relief:- "(a) To issue a writ, order or direction in the nature of mandamus commanding and directing the Opp. party No.2 to sanction the pension of the petitioner w.e.f. 01.08.2024 forthwith and also release the arrear of pension expeditiously or within the time stipulated by this Hon'ble Court. (b) To issue a writ, order or direction in the nature of mandamus commanding and directing the Opp. parties to release entire post retiral dues of the petitioner such as amount of gratuity, leave encashment etc. expeditiously or within the time stipulated by this Hon'ble Court." 3. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. Director General, Family Welfare, U.P., Lucknow, - or any other competent authority who shall consider and decide the same within a period of six weeks from the date of receipt of fresh representation along with a certified copy of this order. In case there is a decision in favour of the petitioner, actual payment thereof shall be ensured within a period of six weeks thereafter.
