Heard learned counsel for the applicant, Shri Dharmendra Kumar Gupta, learned counsel, who has filed his 'vakalatnama' today on behalf of the complainant/informant, which is taken on record as well as learned AGA for the State and perused the material available on record. 2. The applicant seeks enlargement on bail in Case Crime No. 143 of 2025, under Sections 115(2), 352, 351(3), 103(1) and 3/5 of B.N.S., Police Station Talgaon, District Sitapur. 3. The first information report of this case was lodged alleging that on 24.05.2025 at about 5:00 pm., the brother of the informant aged about 40 years was at home and on account of an old enmity, four accused including the applicant came and attack the brother with 'lathi' and 'dandas', in the said altercation, the son of the informant also sustained injuries, subsequently, brother of the informant died on account of the injuries, the postmortem report on record, demonstrate that the cause of death is 'antemortem head injury', the statement of the eye witness(s) on record, states that the applicant was also present, apart from the said, no allegations have been levelled against the applicant who is a lady of causing the offence in question. The applicant is in jail since 27.05.2025 and she is not having any criminal history and, therefore, she is entitled to be released on bail. 4. Learned A.G.A. has opposed the bail application. 5. Considering the statement of the eye witnesses and, there being no material against the applicant of causing the injuries, the applicant who is a lady and is in custody since 27.05.2025 without any criminal antecedents, Versus Counsel for Applicant(s) : Lalit Kishore Tiwari, Himanshu Shukla Counsel for Opposite Party(s) : G.A. Let the applicant- Somvati @ Suman be released on bail in aforesaid FIR number on her furnishing a personal bond with two sureties of like amount to the satisfaction of court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which she is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence.
