District and Session Judge Court No,2 Unnao as well as summoning order dated 08-05-2024 passed by the court of special Judge (SC/ST Act) Add.District and Session Judge Court No.2 Unnao under Sectios-323//504/376 IPC and section 3(2)(v) SCIST Act arisen out from Complain No. CNR UPUNO10068852022 dated 22-12-2021, in the interest of justice. It is further prayed that this Hon'ble Court may pleased to stay the further proceeding in Complain Case No. 536 of 2022 (Sarla v Kishan Pal Lodhi etc.), during the pendency of this Application /Petition under section 482 of the code of criminal procedure, ( 1973(Now Section 528 of B.N.S.S 2023)." 3. Sri Rao Narandra Singh, learned AGA has raised an objection that order has been passed by the Special Court i.e. Special Judge, SC/ST Act/Additional District and Sessions Judge, Court No.2, Unnao and this order is appealable under Section 14(1)A of the SC/ST Act. 4. At this stage, learned counsel for the applicant prays to withdraw present application with liberty to file appeal before the appropriate court.
