HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7891 of 2024 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Supplementary affidavit filed today is taken on record. 2. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 3. The applicant seeks enlargement on bail in S.T. No.194 of 2023, FIR No.334 of 2022, under Sections 302, 498-A IPC and Section 3/4 of D.P. Act, Police Station Makhi, District Unnao. 4. In terms of the FIR, it was alleged that the daughter of the informant was married to the applicant in the year 2015. Subsequently, on account of non-payment of dowry, she was killed by the entire matrimonial family. The cause of death, as per the postmortem report, was ante mortem throttling. 5. It is argued by the Counsel for the applicant that nine of the witnesses have been examined. The applicant is the husband and is in custody since
11.12.2022. 6. Learned A.G.A. vehemently opposed the bail prayer. 7. Considering the postmortem report and the fact that the applicant has no criminal antecedents and is languishing in jail since 11.12.2022 and there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial, I am of the view that the Versus Counsel for Applicant(s) : Furkan Pathan, Durga Prasad Counsel for Opposite Party(s) : G.A. Raj Kumar .....Applicant(s) State Of U.P. Thru. Secy. Home Deptt. Lko. .....Opposite Party(s)
applicant is entitled to be released on bail. Accordingly, the bail application is allowed. 8. Let the applicant Raj Kumar be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
