Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of Respondents in not taking any steps on petitioners complaint/representation, dated 14.03.2025 submitted to take appropriate action against the Respondent Nos.9 to 12, who are persistently humiliating and discriminating us based on their caste which causes immense mental anguish, emotional distress, and a sense of social exclusion and threatening us with dire consequences by using derogatory language, social exclusion, or denial of access to public places, as illegal, irregular, irrational and non-discharge of legal obligation conferred on them under the provisions of Protection of Civil Rights Act, 1955 and Rules framed there under and offends Articles 14,15,17,19 and 21 of the Constitution of India and consequently direct the Respondents to take prompt action against the Respondent Nos.9 to 12 by considering said complaint/representation. 3 The Court made the following ORDER: This Writ Petition has been filed questioning the action of the official respondents in not taking any steps on the petitioners’ complaint/representation dated 14.03.2025 submitted to take appropriate action against respondent Nos.9 to 12, who are persistently humiliating and discriminating the petitioners based on their caste. 2. Case of the petitioners is that 1st petitioner belongs to Scheduled Caste community and 2nd petitioner is her son, aged about 10 years.
She is discouraged from using public spaces due to fear of harassment, assault or other form of violence by respondent Nos.9 to 12 and that respondent Nos.9 to 12 are also not permitting her to use basic amenities in public places, such as public water tanks and to access roads in the village based on their caste. In connection with that, she made a representation dated 14.03.2025 to the respondent authorities requesting them to investigate into the matter and take appropriate action against respondent Nos.9 to 12. 3. A counter affidavit has been filed on behalf of respondent No.8 stating that the representation of 1st petitioner was sent to the Superintendent of Police, Eluru district, through registered post on 14.03.2025 and the same was endorsed to respondent No.8, vide C.No.2569/G2-G/2025, dated 18.03.2025, for enquiry and necessary action. It is further stated that respondent police recorded the statements of neighbours of 1st petitioner along with their signatures, and after examining the neighbours and after going through the relevant material, it has come to light that

4 1st petitioner made false allegations against respondent Nos.9 to 12 and they were not present at the premises of the petitioner’s house at the time of dispute as alleged by her. Accordingly, the respondent police sent reply to the Superintendent of Police, Eluru district and closed the petition. 4. Today, when the matter came up for hearing, learned Assistant Government Pleader submitted that, since no case has been made out against respondents 9 to 12 in the enquiry done by 8th respondent, the petition was closed. In view of the same, no further orders are required to be passed in this Writ Petition. 5. In view of the aforesaid facts and circumstances of the case, the Writ Petition is closed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _______________________ K. SREENIVASA REDDY, J.
