PUBLIC PROSECUTOR The Court made the following: 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 4132/2026 ORDER: This Criminal Petition is filed under Section 483 of the BNSS seeking regular bail for the petitioners/Accused Nos.7 and 8 in connection with Crime No.130 of 2025 on the file of Kothavalasa Police Station, Vizianagaram District, registered for the offences punishable under Sections 318(4), 316(2), 319(2), 336(3), 338 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 66-D of the Information Technology Act. 2. Heard Sri M Sri Atchyut, learned counsel for the petitioners/Accused Nos.7 and 8, and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for the respondent-State. 3. Learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in the present crime. It is contended that they are the sole bread winners of their respective families and that the investigation is almost completed. It is further submitted that the petitioners have been in judicial custody since 21.03.2026 and no useful purpose would be served by their continued detention. Therefore, learned counsel prayed to enlarge the petitioners on bail. 4. Per contra, learned Assistant Public Prosecutor opposed the bail petition contending that the investigation is still pending and substantial amount involved in the cyber fraud is yet to be recovered. It is submitted that if 4 the petitioners are released on bail at this stage, there is every possibility of their absconding and influencing or threatening the witnesses. 5. As seen from the record, the case of the prosecution is that the de facto complainant was contacted by certain persons claiming to be representatives of “ICICI Securities” and was induced to invest in IPOs and block trading through a fake website namely “bkin-Pro.com”. Believing the representations to be genuine, the complainant allegedly transferred an amount of about Rs.74,43,000/- from his bank accounts to the accounts of the accused persons. Subsequently, when the complainant attempted to withdraw the invested amount, the accused allegedly demanded additional concession fees and threatened to revoke his trading privileges, thereby leading to the discovery of the cyber fraud. 6. The material available on record prima facie discloses involvement of the accused in a large-scale cyber fraud involving huge amounts. The investigation is still under progress and the case property is yet to be recovered. At this stage, if the petitioners are enlarged on bail, there is every possibility of hampering the investigation and influencing the witnesses. 7. Having regard to the nature and gravity of the allegations, the stage of investigation, and the apprehension expressed by the prosecution, this Court is not inclined to grant bail to the petitioners at this stage. 8.
