This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

“.... a Writ of Mandamus, declaring the action of the 3rd respondent in issuing proceedings in M.C.No.108/2021 dt.02.07.2021 u/s.145 of Code of Criminal Procedure, 1973 as illegal, arbitrary and one without jurisdiction and consequently direct the respondents not to interfere with the petitioner's land by setting aside the proceedings dated 02.07.2021 of the 3rd respondent.”
2. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that, Section 145 Cr.P.C proceedings are not in force and hence, the relief sought has become infructuous.
3. Sri C.Subodh, learned counsel for the Petitioner would submit that the Police may be directed not to interfere in the land disputes between the Petitioner and the unofficial Respondent.
4. Considering the submissions made, the Writ Petition is disposed of directing the Police not to interfere in the civil disputes between the Petitioner and the unofficial Respondent. There shall be no order as to costs.
