HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 11444 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record.
2. The accused-applicant seeks bail in FIR/Case Crime No.76 of 2025 under sections 85, 80(2) BNS and section 3/4 DP Act, P.S. Malipur, District Ambedkar Nagar.
3. It is argued that the co-accused have been enlarged on bail, although the applicant is not claiming parity as the co-accused were enlarged on bail on the basis of the age grounds. However, the postmortem report on record indicates the cause of death as poisoning and there is no material to substantiate that the applicant had harassed the victim soon before her death in relation to demand of dowry or had administered the poison.
4. Thus, the applicant who is in custody since 15.05.2025 and has no criminal history is entitled to bail. The bail application is allowed.
5. Let the applicant Ankit @ Arun Pathak be released on bail in aforesaid FIR/Case Crime Number subject to her furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of Versus Counsel for Applicant(s) : Rahul Mishra, Ravi Mishra Counsel for Opposite Party(s) : G.A.
