HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10157 of 2025 Court No. - 16 HON'BLE BRIJ RAJ SINGH, J. 1. Heard learned counsel for the accused/applicant as well as learned AGA for the State and perused the record. 2. This Fifth bail application has been moved by the accused/applicant- Umakant for grant of bail in Case Crime No. 0372/2020 under Section 302 IPC and Section 27/30 Arms Act, Police Station Rampur Kalan, District Sitapur, during trial. 3. Learned counsel for the accused-applicant while pressing the bail application submits that six witnesses of fact has been examined and there are 17 more witnesses to be examined. 4. He has submitted that the applicant is in jail since 30.12.2020, therefore, he is entitled for bail. 5. Learned AGA has opposed the prayer for bail on the ground that main role of firing has been assigned to the applicant. 6. Considering the facts and circumstances of the case, I find that there is no sufficient ground and on the same time record reveals that main role of firing has been assigned to the applicant and the case of the applicant is distinguishable to other accused who have been granted bail, I do not find any good ground to release the applicant on bail and therefore the fifth bail application, moved by the applicant is rejected.
