……
CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Shailesh Kr. Singh, Advocate For the State : Mr. Manoj Kumar, AddI. P.P.
…...... 02/ 09.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State.
2.
This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 406/409/420 of IPC.
3.
Petitioner is an employee of Indian Bank.
4.
The allegation in the F.I.R. is that the informant had taken housing loan. He alleges that this petitioner and Manager instructed him to deposit an amount of Rs.5,80,000/- and on such deposit his loan will stand liquidated. He stated that he has given cash to this petitioner, but he alleges that inspite of receiving a cash of Rs.5,80,000/-, the loan was not liquidated and he received the notice of recovery showing a demand of Rs.21, 51,749/.
5.
Learned counsel for the petitioner submits that only after the demand notice was issued with an ulterior motive to coerce the bank officials, this case has been filed. He further submits that proceeding has already been initiated under the SARFAESI Act for recovery. To save his skin, he has filed this case against the Bank officials making false allegation of handing over cash.
6. Considering the nature of allegation and the fact that the SARFAESI proceeding has already been initiated and demand has been issued to the
informant for recovery of Rs.21, 51,749, I feel that this is a fit case for grant of anticipatory bail of the petitioner.
7.
Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Chaibasa, in connection with Chaibasa Sadar P.S. Case No.29 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
8.
Petitioner is directed to appear before the Court concerned as and when required and cooperate with the investigation, failing which, it will be open to the Court concerned, to cancel the bail of the petitioner.
