Heard Mr. Devesh Chandra Verma, learned counsel for the petitioners. Also heard Mr. Malay Jain, learned Panel Lawyer, appearing for respondent No. 1/State. 2. The present petition has been filed by the petitioners with the following prayers: “A. That, the Hon’ble Court may be pleased to kindly quash and set aside the entire criminal proceedings in Session Case No. 65 of 2024 pending before the Additional Session Judge (FTC) Kondagaon (C.G.) and related proceedings against the applicants, in the interest of justice. B. That, the Hon’ble Court may kindly be pleased to quash and set aside the impugned final report dated 26.08.2024 bearing No. 174 of 2024, prepared in 3 Crime No. 111 of 2024, in the interest of justice. C. Any other relief which this Hon’ble Court finds deem fit, in the interest of justice.” 3. On perusal of the prayer in the present petition, it transpires that the present petition is drafted with the prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer as there is no mention of the offences under which charge-sheet has been submitted before the trial Court and offences under which the FIR has been lodged against the petitioners, to which learned counsel for the petitioners seeks permission of this Court to withdraw the present petition with a liberty to file afresh petition with proper prayer. 4. Learned State counsel has no objection. 5. In view of the submission made by the learned counsel for the petitioners, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioners before the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government School for Visual and Hearing Impaired, Bilaspur (C.G.). 6. Certified copy of the order-sheet, charge-sheet and FIR may be returned back to the petitioners after retaining a photocopy of the same.
