1. Since common question of law and fact is involved in both the case, therefore, they are heard together and are being disposed of by this common order.
2. Mr. Manoj Paranjpe, Advocate, appearing for appellant – Shree Salasar Balaji Ferro Alloys Private Limited, on instructions, would submit that the appellant – Company is ready to give undertaking that no 3rd party interest shall be created in any manner with regard to suit property, till disposal of the civil suit No. 30-A/2024 {Deepak Daga Vs. Shri Salasar Balaji Ferro Alliance Private Limited}. As such, under this undertaking both the appeals may be disposed of.
3. Mr. Chandraesh Shrivastava, learned counsel appearing for respondent No. 1 – Deepak Daga would submit that he has no objection to disposed of both the appeal under aforesaid undertaking given by appellant {in M.A. No. 86 /2025}
3 namely Shree Salasar Balaji Ferro Alloys Private Limited.

Both the appeals have been preferred challenging the impugned order dated 12.03.2025 passed by Principal District Judge, Rajnandgaon in Civil Suit No. 30- A/2024 whereby learned trial Court has ordered that no third party interest shall be created in any manner in respect of suit property, till disposal of the civil suit.
5. Having considered the undertaking given on behalf of appellant - Shree Salasar Balaji Ferro Alloys Private Limited and no objection made by opponent counsel appearing on behalf of Deepak Daga / plaintiff, both the appeals are
disposed of under the aforesaid undertaking and appellant - Shree Salasar Balaji Ferro Alloys Private Limited is directed not to create third party interest in any manner with regard to suit property, till disposal of civil suit No. 30-A/2024 {Deepak Daga Vs. Shri Salasar Balaji Ferro Alliance Private Limited}.
6. With the aforesaid directions & undertaking givey by appellant Shri Salasar Balaji Ferro Alliance Private Limited, both the misc. appeals stand disposed of. However, the trial Court is directed to expedite the trial and conclude the same as early as possible preferably within a period of six months from the date of receipt / submission of copy of this order.
7. Both the parties are directed that they will cooperate in expeditious trial and conclusion of the case.
8. In view of above, interim relief granted by this Court on 26.03.2025 in MA No. 57 / 2025 (Depak Daga vs. Shri Salasar Balaji Ferro Alliance Private Limited) is recalled. Sd/- (Naresh Kumar Chandravanshi) Judge amit
