Heard learned counsel for the petitioners and the learned AGA for the State- respondents. This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of certiorari for quashing of impugned FIR dated 17.3.2024 registered as FIR/Case Crime No. 0088 of 2024 under Sections 323, 504, 506 IPC at Police Station- Paliya, District Lakhimpur Kheri. Learned AGA, on the basis of instructions, states that subsequent to the lodging of the impugned FIR, charges sheet dated 17.5.2024 has already been filed in Court and the petitioners have been summoned in the matter. The aforesaid statement of the learned AGA has been recorded. After arguing the matter at some length, learned counsel for petitioners prays that he may be permitted to withdraw the writ petition with liberty to pursue other remedies that may be available to him under law. Learned counsel for respondents has no objection to the prayer made by learned counsel for the petitioners. Accordingly, the writ petition is dismissed as withdrawn with aforesaid liberty.
