THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 13311/2025 ORDER:
This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“Pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents 2 to 4 in not considering my application dated 17.01.2023 and submitted for the grant of D-Form Patta for 0.35 cents of land in Sy.No.1528 Chinakandlagunta Village Kondapi Mandal, Prakam District inspite of proposals submitted by 4th respondent on 17.01.2023 to 2nd respondent as illegal, arbitrary, irrational and violative of Principals of Natural Justice and violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to assign the said land in my favour being Sivojimadar by considering my said application by way of granting D-Form Patta in my favour for the said land and pass such other order or orders.”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that the petitioner submitted an application dated 17.01.2023 seeking for grant of D-Form patta in respect of the land measuring to an extent of Ac.0.35 cents in Sy.No.152-8 at Chinnakandlakunta Village, Kondepi Mandal, Prakasam District. Even after receipt of the same, the respondents are neither taking any steps for
assignment nor rejecting the said application by giving necessary reasons. 4. On the other hand, learned Assistant Government Pleader for the respondents furnished written instructions dated 15.06.2025 issued by the 4th respondent, wherein it is stated that as the land to an extent of Ac.5.44 cents in Sy.No.152 was denoted as
“Kancha Poramboke” in ROH copy of Chinakandlagunta Village, the request of the petitioner was returned to the office of respondent No.4. 5.
Learned Assistant Government Pleader for the respondents further submits that if the petitioner has any grievance with regard to the returning of the proposal of the petitioner, the petitioner may challenge the same by way of availing appropriate remedies. 6. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents and in view of the written instructions furnished by the 4th respondent, this Court deems it appropriate to dispose of the Writ Petition directing the petitioner to avail appropriate remedies before the authority
concerned, if he has any further grievance with regard of the assignment of the subject land, in accordance with law. 7. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel miscellaneous application, pending, if any, shall also stand closed. ________________________________
