Heard Shri Amitabh Agarwal, learned Advocate appearing for petitioners. 2. Petitioners before this court want expeditious disposal of pending 6-C application for temporary injunction. 3. It is submitted that after the suit was instituted notices got issued on 22.11.2024 by both modes for which steps were taken, however, the defendents have not yet put in appearance. It is submitted that now the date fixed is 10.03.2025. It is also submitted that Amin Commissioner's report has also been obtained in the matter according to which the construction activities at the end of the defendents qua suit property are going on. It is thus, submitted by Shri Amitabh Agarwal that in the event injunction application is not considered and temporary relief/ interim relief is not granted only on the ground that defendants have not yet put in appearance in the case, it will cause serious prejudice to the rights and interest of petitioner. 4. In the given facts and circumstances, this petition stands disposed of with the direction to the trial court concerned to consider the grant of temporary injunction in the nature of interim relief to the petitioner awaiting service of summons/ notices to the defendants on the next date fixed or within next two weeks' time. It is further provided that after the defendants put in appearance and they file their objection 6-C application may be finally disposed of within further period of two months.
