Perused the report in the form of affidavit filed by the Eastern Coalfields Limited. The report mentions that as per the policy of the respondent authority, the petitioner may be considered for payment of MMCC with effect from the date of death of the employee provided the petitioner furnishes all necessary required documents in light of the judgment passed in the matter of Maya Bouri Vs. Eastern Coalfields Limited in WPO No.33 of 2025. The authority has not accepted the prayer for payment of interest as the petitioner did not proceed with her claim diligently. 2. Learned advocate for the petitioner submits that the authority be directed to take necessary steps for payment of MMCC to the petitioner. 2 3. In view of the submissions made by the parties and relying on the report filed by the Eastern Coalfields Limited, the instant writ petition stands disposed of by directing he respondent no. 5 herein to take steps for calculation and payment of MMCC in favour of the petitioner with effect from the date of death of the employee. The document(s) which the petitioner would be required to produce for release of MMCC, shall be specifically intimated to her. The petitioner would be obliged to forward the document(s) as sought for. Steps shall be taken for payment of MMCC at the earliest, but positively within a period of twelve weeks from the date of communication of this order. 4. As regards the claim of the petitioner for interest, the same is not being decided in the instant writ petition. The issue is left open to be decided as and when occasion so arises. 5. The impugned order of the respondent authority dated 4th August, 2025 stands set aside. 6.
