Accordingly, both these cases are being disposed of by a common order. 2. Heard the parties. 3. The petitioners have been made accused in connection with Saraiyahat P.S. Case No. 68 of 2025 for the offences registered under Sections 111, 318(4), 319(2), 336(3), 338 and 340(1) of the Bharatiya Nyaya Sanhita, 2023, section 66C and 66D of the I.T. Act and section 42(3)(e) of the Telecom Act, pending in the court of Smt. Neha Jha, learned Judicial Magistrate, 1st Class, Dumka. 4. On 05.05.2025 at 12.00 noon, Saraiyahat Police on the basis of confidential information that cyber criminals have assembled in village Mandaldih, raided the place of occurrence and apprehended this petitioner along with co-accused persons. On search, one mobile phone is alleged to have been recovered from the possession of the petitioner Chhotu Kumar @ Chhotu Kumar Mandal and Two mobile phones are alleged to have been recovered from the possession of the petitioner Badal Kumar Mandal. 5. It was submitted that the prosecution has not examined any witness to show that the mobile phone so recovered from the possession of the petitioner, was used in cheating him. It was further submitted that similarly situated co-accused persons have been granted bail by this Court earlier. 6. In view of the submissions made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of Smt.
