This writ petition is filed under Article 226 of the Constitution of India, claiming the following relief: “to issue a writ, direction or order, particularly one in the nature of Mandamus by declaring the action of the third respondent in not paying the balance structure value of Rs.8,25,420/- (Rupees Eight Lakhs Twenty Five Thousand Four Hundred and Twenty only) determined as per the valuation report dated 20.04.2023 issued by Respondent No.5 along with other applicable additional benefits under the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act 2013 concerning the Petitioners structure situated in Sy.No.498/4A Velvadam Village, Mylavaram Mandal, N.T.R District and the inaction of Respondents Nos.2, 3 and 4 in failing to consider and dispose of the Petitioners representation dated 07.12.2024 as arbitrary illegal and in violation of Articles 14 and 21 of the Constitution of India besides being a violation of principles of natural justice Consequently it is prayed that Respondent No.3 be directed to pay the balance structure value of Rs.8,25,420/- (Rupees Eight Lakhs Twenty Five Thousand Four Hundred and Twenty) only as per the valuation report given by the 5th respondent dated 20.04.2023 Annexure P2 and along with other applicable additional benefits as per the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act 2013 and to consider and dispose of the applications made by the petitioner dated 07.12.2024 Annexures P3.” 3 2. Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner requested this Court, without touching the merits of the case, to issue a direction to the respondents to dispose of the representation of the petitioner dated 07.12.2024. 3. Learned Assistant Government Pleader for Revenue readily agreed to dispose of the representation of the petitioner dated 07.12.2024, if any pending with the authorities. 4. In view of the submission of the learned Assistant Government Pleader for Revenue, I need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do no service to the cause of justice. As the learned counsel for the petitioner herself requested to issue a direction to the respondents to dispose of the representation dated 07.12.2024, with a liberty to make representation under the Right to Information Act for obtaining necessary information/documents, I find no other alternative except to issue such direction. 1 2019 (8) SCALE 544 4 5. In the result, the writ petition is disposed of directing the respondents to consider and dispose of the representation dated 07.12.2024 made by the petitioner, in accordance with law, within four (04) months from today. No costs. 6.
