Heard the parties.
The petitioner has been made accused in connection with Potka P.S. Case No. 05 of 2025, corresponding to G.R. Case No.593 of 2025, for the offence under Section 310(2) of Bharatiya Nyaya Sanhita, 2023, pending in the court of Sri Arvind Kumar No.III, learned Judicial Magistrate, 1st class, Jamshedpur.
During the intervening night of 18 / 19.01.2025, unknown dacoits looted a transformer from Vidyut Shakti Upkendra, Hata, Jamshedpur.
It was submitted that the petitioner is neither named in the FIR, nor he was put on T.I. Parade. However, it was further submitted that on the pointing out of the petitioner, copper wire was recovered. It was also submitted that petitioner is in custody since 30.01.2025. It was finally submitted that similarly situated co-accused persons have been granted bail by this Court as well as by the Coordinate Bench of this Court.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Arvind Kumar No.III, learned Judicial Magistrate, 1st class, Jamshedpur, or his successor, in connection with Potka P.S. Case No. 05 of 2025, corresponding to G.R. Case No.593 of 2025.
