HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 15440 of 2025 Court No. - 32 HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri R.C. Dwivedi, learned counsel for petitioner and Sri Santosh Kumar, learned Standing Counsel for State-Respondents.
2. Petitioner has retired recently on 03.04.2025. Now the Principal of concerned College has issued a notice dated 19.09.2025 to petitioner that he has to participate in an inquiry with regard to B.Ed. Examination of 2003. Admittedly, petitioner has not submitted any reply to notice and has rushed to this Court.
3. Learned counsel for petitioner submits that such notice cannot be issued to petitioner after his retirement.
4. I have considered the above submission.
5. Since only a notice has been issued to petitioner and an opportunity is granted to submit his reply, therefore, instead of granting any relief as sought, the writ petition is disposed of at this stage that petitioner will submit his reply on facts as well as on law within seven days from today. Subsequently said Inquiry Committee will consider at first instance the legality of notice and will pass an appropriate order within two weeks thereafter. Meanwhile, claim of petitioner for retiral benefits may also be considered in accordance with law by Competent Authority.
