This criminal miscellaneous petition has been filed by the petitioner invoking the jurisdiction of this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer for modification of the order dated 25.06.2025 passed in B.A. No.5037 of 2025. It is submitted by the learned counsel for the petitioner that vide order dated 25.06.2025 passed in B.A. No.5037 of 2025, the petitioner was admitted to bail subject to showing proof of deposit of Rs.24,155/- in the bank account of the victim Maninder Singh. It is next submitted that in fact, the name of the victim is Poonam Singh but the same has wrongly been mentioned as Maninder Singh in place of Poonam Singh and the total defrauded amount is Rs.92,899/-, which has wrongly been mentioned as Rs.24,155/-. It is next submitted that the petitioner undertakes to transfer Rs.92,899/- in the bank account of Poonam Singh. Hence, it is submitted that the order dated 25.06.2025 passed in B.A. No.5037 of 2025 be modified by substituting the name of the victim ‘Maninder Singh’ with ‘Poonam Singh’ and the defrauded amount being ‘Rs.24,155/-‘ mentioned in the said order be also modified with the amount ‘Rs.92,899/-‘. Learned Spl.P.P appearing for the State has not raised any objection. Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for modification of the order dated 25.06.2025 passed in B.A. No.5037 of 2025 is allowed. Accordingly, the order dated 25.06.2025 passed in B.A. No.5037 of 2025 is modified by substituting the name of the victim ‘Maninder Singh’ with ‘Poonam Singh’ and the defrauded amount being ‘Rs.24,155/-‘ mentioned in the said order is also modified with the amount ‘Rs.92,899/-‘ and it is ordered that this order be treated as the part of the order dated 25.06.2025 passed in B.A. No.5037 of 2025. The order dated 25.06.2025 passed in B.A. No.5037 of 2025 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly. (Anil Kumar Choudhary, J.) Animesh/
