GP FOR REVENUE The Court made the following: 2 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 13170/2025 ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent authorities in kept pending the Spandana complaint made by the petitioner dated 29.07.2024 vide its No.ANPL202407291347 requesting to place the web land entries in disputed list over the land of Katha No.875 in Survey No.142-1 of extent Ac.0.24 cents, in Survey No.150 of extent Ac.0.74 cents, in Survey No.150 of extent Ac.0.18 cents, in survey No.142-2 of extent Ac.0.73 cents, in survey No.142-2 of extent Ac.0.08 cents, Ac.0.15 cents, in survey No.156 of extent Ac.0.38 cents and land in katha No.884 in survey No.130-1 of extent Ac.0 .5 cents in toted of extent Ac.3.23 cents of land in view of the proceedings issued by the 4th respondent vide its proceedings No.L.Dis.No.562/2016/SA dated 10.11.2016 and proceedings of 3rd respondent vide its No.Rec.No.714/2015/I.D.T/ dated 20.12.2017 without following procedure established by the law is as illegal, arbitrary and violation of principles of natural justice, violative of Art 14, 15, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents to place the subject lands in Katha No.875 and 884 of total extent Ac.3.23 cents in the disputed list by following the due procedure established by the law in view of the proceedings issued by the 4th respondent vide its proceedings No.L.Dis.No.562/2016/SA dated 10.11.2016 and proceedings of 3rd respondent vide its No.Rec.No.714/2015/I.D.T/ dated 20.12.2017 and pass such other order.” 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue for the respondents. 3 3. Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner requested this Court, without touching the merits of the case, to issue a direction to the respondents to dispose of the complaint/application made by the petitioner dated 29.07.2024. 4. Learned Assistant Government Pleader for Revenue readily agreed to dispose of the complaint/application dated 29.07.2024, if any pending with the respondents. 5. In view of the submission of the learned Assistant Government Pleader for Revenue, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to dispose of the complaint/application dated 29.07.2024, this Court find no other alternative except to issue such direction. 6. In the result, the Writ Petition is disposed of, directing the respondents to consider and dispose of the complaint/application 1 2019 (8) SCALE 544 4 dated 29.07.2024 submitted by the petitioner, after providing opportunity of hearing to the parties concerned, within a period of three(3) months from the date of receipt of a copy of this order. There shall be no order as to costs.
