Learned counsel for the revisionist and the learned A.G.A. are present. None has appeared on behalf of opposite party no. 2 despite service of notice. 2. Under challenge is the impugned order dated 05.06.2025 passed by the learned Additional District and Sessions Judge/Special Judge (POCSO Act), Court No. 3. Ghaziabad, in Special Criminal Case No. 332 of 2023 (State Vs. Surjeet Singh and others) arising out of Case Crime No. 606 of 2023, under Section 323 LP.C., Police Station Vijaynagar, District Ghaziabad, whereby discharge application filed by the revisionist under Section 239 of Cr.P.C. numbered 15-Kha was rejected. 3. Heard learned counsel for the revisionist and the learned A.G.A. Perused the record. 4. On perusal of the record, it transpires that an FIR was registered on 4.8.2023 under Section 354, 323 IPC and Section 7/8 of POCSO Act, 2012 against revisionist/Kavita and her husband Surjeet Singh. After complete investigation, the charge sheet had been filed under Section 323 IPC against the revisionist/Kavita whereas the charge sheet under Sections 354,323 IPC and Section 7/8 of POCSO Act, 2012 had been filed against main accused/Surjeet Singh. The revisionist/ Kavita is already on bail. 5. The learned trial court had passed the impugned order dated 5.6.2025, after consideration of all the facts and circumstances and Versus Counsel for Revisionist(s) : Lavkush Kumar Bhatt Counsel for Opposite Party(s) : G.A. Kavita .....Revisionist(s) State Of U.P. And 3 Others .....Opposite Party(s) the papers of investigating officer. The victim is a minor and there are serious allegation of sexual assault. Therefore, there seems to be no irregularity or erroneousness in the impugned order dated 5.6.2025. The impugned order is hereby confirmed. 6. The criminal revision is accordingly dismissed.
