1. By the present writ petition, the petitioner, who is working as Assistant Grade- III is seeking a direction towards the respondent authorities for consideration of the case of the petitioner for promotion to the post of Assistant District Prosecution Officer (ADPO).

Learned counsel for the petitioner submits that by communication dated 14.11.2024, Home Department has directed the Director, Directorate of Prosecution to provide the corrected proposal and ACR of the Class III employees for promotion to the post of Assistant District Prosecution Officer (ADPO). He further submits that the petitioner has also submitted representation dated 07.03.2025 before respondent No. 2 seeking consideration of his case for promotion to the post of Assistant District Prosecution Officer (ADPO) but inspite of the communication of the Home Department neither the respondent No. 2 has sent the correct proposal or ACR for consideration for promotion to the post of Assistant District Prosecution Officer (ADPO) nor the representation of the petitioner has been decided. He further submits that the writ petition be disposed off with a direction to the respondent No. 2 to consider the pending representation of the petitioner dated 07.03.2025.
3. Learned State counsel submits that if the representation of the petitioner is still pending before respondent No. 2, the same will be considered in accordance with law and necessary steps will be taken in accordance with law.

4. I have heard learned counsel for the parties and perused the pleadings and the communication dated 14.11.2024 and the representation dated 07.03.2025 by which the petitioner is claiming consideration of his name for promotion for the post of Assistant District Prosecution Officer (ADPO).
5. Considering the facts and circumstances of the case, respondent No. 2 is directed to decide the representation dated 07.03.2025 in accordance with law within a period of 45 days from the date of receipt of a copy of this order.
