ORDER:-
Learned counsel appearing for the petitioner submits that the petitioner had challenged the suspension proceedings dated 03.04.2025 which were suspended by this Court vide order dated 16.04.2025. Thereafter, the respondents vide proceedings dated 22.05.2025, have reinstated the petitioner, subject to the outcome of the writ petition. It is further submitted that the petitioner is physically challenged and is entitled for promotion to the post of Assistant Depot Clerk. It is also submitted that the petitioner was selected against the P.B.D quota for promotion, however, the promotion was kept pending in view of the pendency of the present writ petition.
2. The learned Standing Counsel submits that the respondents have filed a vacate petition in W.P.No.3959 of 2025 and that the respondents have no objection in the event the petitioner intends to withdraw the writ petition.
3. Considering the submissions that the petitioner is entitled for promotion and the suspension orders are stayed by this Court.
4. Accordingly, the Writ Petition is closed, leaving it open for the respondents to consider the case of the petitioner for promotion on par with other employees, the same shall be subject to the outcome of W.P.No.3959 of
2025. There shall be no order as to costs.
