1 2025:CGHC:18705 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 3136 of 2025 1 - Dhananjay Painkra S/o Puran Painkra Aged About 18 Years Caste - Kanwar, R/o Kukurbhuka, Police Station - Bagbahar, District - Jashpur Chhattisgarh ... applicant versus 1 - State Of Chhattisgarh Through Station House OfÏcer, Police Station - Bagbahar, Disrict - Jashpur Chhattisgarh ...Non-applicant For applicant : Mr. Manoj Chauhan, Advocate For Res./State : Mr. G. L. Uikey, Panel Lawyer Hon’ble Shri Justice Ravindra Kumar Agrawal Order on Board 24.04.2025 1. This is the second bail application of the applicant. Vide order dated 04.12.2024, passed by this Court in MCRC No. 6340 of 2024, the first bail application of the applicant was dismissed as withdrawn with a liberty to repeat the same after examination of the material witnesses. 2. Learned counsel for the applicant would submit that after dismissal of the first bail application of the applicant on 04.12.2024, the Patwari (PW04) has been examined on 31.12.2024. The applicant is in jail since 20.11.2023 and 2 the final adjudication will take its own time, therefore, the applicant has filed this second bail application. 3. On the other hand, learned State counsel opposes the bail application. 4. From perusal of the documents Annexure A/3 which are the depositions of PW01, PW02 PW03 who are the victim and her parents. it transpires that the victim and her mother has been examined on 30.04.2024 and father of the victim has also been examined on 30.07.2024 which are much prior to the dismissal order passed in first bail of the applicant on 04.12.2024. Though, the applicant would submit that Patwari (PW04) has been examined but no copy of his deposition has been annexed with the present bail application, since there is no change in circumstance after 04.12.2024, I do not find any good ground to admit this second bail application of the applicant. 5. Accordingly, the present second bail application of the applicant is dismissed at the motion hearing stage.
