Masud … for the State-respondent(s) The petitioner is aggrieved by the fact that in spite of the direction passed in T.S. 413 of 2021, the private respondents are adamant in disturbing her possession. To that effect, an information was furnished with the police authorities. However, in spite of receipt of the information, the police authorities are not responding and abiding by the order passed by the learned Civil Judge (Jr. Divn.), Additional Court at Lalbagh. Learned advocate for the State has submitted a report which reflects that the police authorities have kept strict vigil and have taken steps as and when they have received information so that there is no breach of peace. I have considered the submissions advanced by the petitioner and I am of the view that if the petitioner, if so advised, would prefer appropriate application before the learned Civil Judge already in seisin of the civil dispute for rendering proper police assistance in respect of implementation of the order, and, in case, any order and/or direction is passed, the police authorities would respect, obey and implement such order/direction. In the meantime, the police authorities would continue their surveillance and ensure that no untoward incident results because of the inimical relationship existing between the parties. With the aforesaid observations, WPA 8889 of 2024 is disposed of. Pending application(s), if any, is also disposed of.
