2025:JHHC:11384 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.4486 of 2024 ------ Warnadat Beg @ Bernadette Beck, wife of Augusstin Murmu (aged about 69 years), resident of village Garang, PO Jagsimar, PS Bhelwaghati, District Giridih … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Ram Lakhan Yadav, Advocate. For the State : Mr. Sudhir Kumar Roy, A.P.P. ----- 11/ 15.04.2025 Heard the parties. 2. This anticipatory bail application under Section 438 of the Code of Criminal Procedure, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 304, 326, 34 of the Indian Penal Code in connection with Deori PS Case No. 164 of 2023 pending in the Court of learned J.M. 1st Class, Giridih. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. It is the case of the informant that when his wife was having pain, his mother and mother-in-law took her to Community Health Centre, Deori where hospital staffs including this petitioner who was posted as ANM had informed his mother and mother-in-law that there is some unique type of article which is present inside the stomach of his wife so washing has to be done. They took out something from her stomach and told them that washing has been done and she can be taken to their house but in the next morning she died. 5. Considering the nature of the allegation and the fact that the petitioner being ANM was not qualified to treat the deceased and knowingly treated and administered medicine upon the deceased, I am not inclined to grant anticipatory bail to the petitioner, accordingly, this Anticipatory Bail Application stands dismissed.
