HIGH COURT OF JUDICATURE AT ALLAHABAD APPEAL AGAINST ACQUITTAL IN SC/ST ACT No. - 5 of 2024 Court No. - 86 HON'BLE SHEKHAR KUMAR YADAV, J. 1. Heard learned counsel for the appellant as well as learned A.G.A. 2. The present criminal appeal has been filed by the State of U.P, (Under Section 14A(1) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the impugned judgment and order of acquittal dated 30.05.2024 in Special Case No. 13 of 2018, (State of U.P. Vs. Hridesh Yadav). 3. It is contended by learned counsel for the State that the prosecution has produced the sufficient medical evidence regarding the incident but the learned trial court has ignored the same aspect and erroneously and illegally acquitted the accused- respondent. 4. I have perused the impugned judgement recorded by the trial court. 5. The trial court's judgment, dated 30.5.2024 meticulously analyzed the evidence presented by the prosecution. The court's reasoning for acquittal is sound and based on a thorough appreciation of the evidence. The trial court correctly concluded that the prosecution failed to prove the charges beyond a reasonable doubt. There are no grounds for granting special leave to appeal. Therefore, no interference with the trial court's well-reasoned decision is warranted. The appeal is accordingly dismissed. The judgment of the trial court is upheld. 6. Consequently, the appeal is accordingly dismissed. October 15, 2025 Krishna* Versus Counsel for Appellant(s) : A. K. Sand Counsel for Respondent(s) : (Shekhar Kumar Yadav,J.)
