This is plaintiff's petition. In a suit filed by the plaintiff an application for grant of temporary injunction was moved which was rejected by the trial court, against which a misc. civil appeal No. 42 of 2024 was filed which is pending consideration. During pendency of the said appeal, petitioner had preferred an application for early disposal of the appeal, which has been rejected by the order impugned. 2. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondent, by setting aside the order dated 20.01.2025 passed by the District Judge, Kannauj and requesting him to proceed with the Misc. Civil Appeal No. 42 of 2024 and decide the same, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. 3. With the aforesaid directions, writ petition stands disposed off. 4. It is made clear that this Court has not adjudicated the matter on merits.
