And 4 Others Counsel for Petitioner :- Shivendu Ojha,Sneh Pandey,Sr. Advocate Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J.
1. Petitioners, through this writ petition, have questioned the validity of the order dated 17.11.2023 passed by the District Inspector of Schools, Maharajganj/respondent no. 4, terminating the services of petitioners, who claim to have been appointed in the year 1988. Petitioners had sought regularization but they were denied on the ground of the Government Order dated 9.11.2023 issued by the State Government on the basis of a judgment rendered by Apex Court and their services were terminated.
2. This Court in case of Writ-A No. 21492 of 2023 (Vinod Kumar Srivastava Vs. State of U.P. & Others) decided on 30.9.2024 in paragraph no. 149 had laid down the guidelines for
consideration of regularization by the Regional Regularization Committee. Post decision, the Government had issued a Government Order on 4.10.2024 and the matter needs to be considered in the light of the judgment rendered by this Court in case of Vinod Kumar Srivastava (Supra) and the Government
Order dated 4.10.2024.
3. In view of the said fact, the order impugned dated 17.11.2023 passed by the District Inspector of Schools, Maharajganj is hereby set aside. The matter is remitted to the Regional Regularization Committee for reconsideration afresh, in terms of paragraph no. 149 of the judgment rendered in case of Vinod Kumar Srivastava (Supra) as well as the Government Order dated 4.10.2024, within a period of three months from the date of production of a certified copy of this order before the committee.
4. Writ petition stands partly allowed. Petitioners shall be entitled to get the salary till fresh decision is taken by the Regional Regularization Committee.
