HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 30915 of 2025 Court No. - 67 HON'BLE KRISHAN PAHAL, J.
1. List has been revised. 2. Heard Sri Ajay Tripathi, learned counsel for applicant, Sri Deepak Kumar Singh, learned A.G.A. for the State and perused the material placed on record. 3. The present bail application has been filed by the applicant in Case Crime No.806 of 2021, under Sections 302 and 307 IPC, Police Station Sector 39 Noida, District Gautam Buddh Nagar with the prayer to enlarge him on bail. 4. As per prosecution story, the applicant, who happens to be the son-in-law of the informant, is stated too have come to the house of the informant and assaulted his wife Kranti, his sister-in-law Bhagwati and his niece Ritika, causing stab wounds to all, thereby leading sister-in-law Bhagwati to death on 09.10.2021 at about 7:30 a.m.
5. Learned counsel for the applicant has stated that the FIR is delayed by about fourteen hours and there is no explanation of the said delay caused. It is true that three persons had sustained stab wounds, but the allegations are per se false. It is a case of sudden provocation as an altercation ensued over sending the wife of the applicant Kranti alongwith him. 6. Learned counsel for the applicant has further stated that the applicant is languishing in jail for about four years i.e. 10.10.2021 and is ready to cooperate with trial. In case, the applicant is released on bail, he will not Versus Counsel for Applicant(s) : Ajay Tripathi, Surya Prakash Pandey Counsel for Opposite Party(s) : G.A. misuse the liberty of bail. 7. Per contra, learned A.G.A. has vehemently opposed the bail application on the ground that several witnesses have been examined and the applicant is the only named accused person who had assaulted his wife alongwith his sister-in-law and niece, thereby causing injuries to them, leading one of them to death. 8. After hearing learned counsel for the parties and taking into consideration the fact that the applicant is named in the FIR and he had assaulted three persons in all causing injuries to them, leading one of them to death, I do not find it a fit case for grant of bail to the applicant. The bail application is found devoid of merits and is, accordingly, rejected. 9.
However, it is directed that the aforesaid case pending before the trial court be decided expeditiously as early as possible in view of the principle as has been laid down in the recent judgments of the Supreme Court in the cases of Vinod Kumar vs. State of Punjab; 2015 (3) SCC 220 and Hussain and Another vs. Union of India; (2017) 5 SCC 702, if there is no legal impediment. 10. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
